Copyright, trademark and IP notice

1. Ownership and reservation of rights

Except for identified third-party, open-source and open-data materials, the AERLYO website, applications and services—including original source and object code, architecture, interface, layouts, written content, graphics, icons, audio-visual material, workflows, selection and arrangement, documentation, models, configuration, non-public data and database compilations—are owned by Thoth Group LLC, assigned to it, or used under license. They are protected by United States and international copyright, trademark, trade-secret, database-right, unfair-competition and other laws. All rights not expressly granted in writing are reserved.

Copyright notices, rights-management information, source identifiers, watermarks, attribution, trademark notices and technical controls must not be removed, concealed or altered. No access, subscription, API response, screenshot, link, metadata record or course of conduct transfers ownership or grants an implied license.

1A. Idea credit, development credit and contributor assignments

“An idea by J. Faff, realized by Adel Ramzy’s development team” is a requested attribution credit. It does not by itself grant or determine copyright, patent, trademark, corporate, revenue, authorship or operational rights. Ownership of protectable implementation is governed by applicable law and the signed invention, copyright, work-made-for-hire, confidentiality and assignment agreements among Thoth Group LLC and the relevant creators.

Every employee, developer, designer, photographer, contractor, agency and model or asset supplier must warrant originality and authority, identify third-party or open-source components, and execute the written assignment or license required by Thoth before material enters production. This public notice does not replace those signatures. Thoth should retain dated source history, design files, invoices, licenses and assignment records as evidence of title.

2. Limited permitted use

Subject to the Terms / CGU, Thoth grants an authenticated user a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the applicable AERLYO interface and use it for the user’s intended personal or authorized internal business purpose during the account term. The license ends when the account or applicable service ends and does not include source code, raw feeds, administrative methods or non-public documentation.

Except where a restriction is prohibited by mandatory law or an identified open license expressly allows it, no person may reproduce, adapt, translate, distribute, publicly display, republish, sell, rent, sublicense, scrape, crawl, index, frame, mirror, cache beyond technical necessity, benchmark for publication, reverse engineer, disassemble, decompile, derive source code, extract models or features, train a competing model, remove attribution from, or create a substitute or competing service from protected AERLYO material without prior written permission. Interoperability or security research permitted by law must be limited to what is legally necessary and must not compromise people, aircraft, credentials, confidential data or service availability.

Press, partnership and licensing requests must identify the exact material, intended use, audience, territory, duration, format and publication channel. Silence is not consent.

2A. Databases, live data, APIs and automated access

AERLYO’s selection, verification, normalization, enrichment, matching, scoring, relationship mapping and arrangement of non-public operator, owner, aircraft, trip and account information may be protected independently of individual facts. No right is granted to extract or reutilize all or a substantial part of a protected database, repeatedly extract insubstantial parts in a manner that conflicts with normal exploitation, reconstruct registrations from rotating identifiers, correlate live positions to identify private participants, or create a substitute availability, pricing, lead, aircraft or tracking database.

Automated access is allowed only through a written API or data agreement, issued credentials and documented limits. Credentials are personal to the authorized organization and must not be shared. Thoth may meter, rate-limit, suspend, rotate or revoke access and require deletion or return of protected data. Provider and open-data restrictions continue to apply even when data passes through an AERLYO endpoint.

2B. User submissions, operational data and feedback

A user retains any copyright it owns in material it lawfully submits. The user grants Thoth, its affiliates, processors and authorized marketplace participants a worldwide, non-exclusive, royalty-free license to host, encrypt, reproduce, transform for technical compatibility, analyze, transmit and display that material only as reasonably necessary to operate, secure, verify, audit and improve the Platform, fulfill the request, enforce agreements, resolve disputes and comply with law. This license ends when no longer needed, subject to legal retention, backup and de-identification.

The user warrants that it owns or is authorized to provide the material and that permitted processing will not violate intellectual-property, confidentiality, privacy, publicity, employment or contractual rights. Unsolicited product suggestions and feedback may be used by Thoth without restriction or compensation, provided Thoth does not acquire ownership of the user’s confidential information merely because feedback was sent.

3. Open-source, open-data and third-party material

The worldwide airport directory is derived from OurAirports data, described as public-domain data by its publisher. Live ADS-B data is provided by adsb.lol contributors under the Open Data Commons Open Database License 1.0. Licensed aviation feeds, maps, fonts, software packages, payment components and other materials remain governed by their respective agreements and required notices. Where an open-source or open-data license conflicts with this notice for that component, the component’s license controls.

Aircraft manufacturer names, aircraft images, operator names, airports, payment brands, Apple and other third-party marks belong to their respective owners. Their nominative appearance identifies compatibility, data source or marketplace context and does not imply endorsement, partnership, certification, ownership or aircraft availability. A third-party asset must not be used in production without documented license scope, attribution, territory and duration.

4. Copyright infringement notices

If you believe material available through AERLYO infringes your copyright, send a signed notice to legal@nawaeurope.com containing: identification of the copyrighted work or a representative list; identification and URL or other precise location of the allegedly infringing material; your name, postal address, telephone number and email; a statement of good-faith belief that the use is not authorized by the owner, agent or law; a statement under penalty of perjury that the notice is accurate and that you are the owner or authorized to act; and your physical or electronic signature.

Thoth may request missing information, preserve the notice, forward it to the supplier, remove or restrict material expeditiously, notify the account holder and take other action required by law. Knowingly material misrepresentation may create liability. To seek United States DMCA safe-harbor treatment for eligible hosting or linking activity, Thoth must separately register and renew a designated agent with the U.S. Copyright Office and publish that agent’s complete name, postal address, telephone and email here. This notice does not claim that registration has occurred; the verified registration details must replace this sentence before relying on the safe harbor.

5. Counter-notices

If your material was removed by mistake or misidentification, you may send a signed counter-notice identifying the removed material and its prior location; stating under penalty of perjury your good-faith belief that removal resulted from mistake or misidentification; providing your name, postal address, telephone number and email; consenting to the jurisdiction of the appropriate United States federal district court, or if outside the United States to a judicial district where Thoth may be found, and accepting service from the original notifier; and providing your physical or electronic signature.

Where the statutory process applies, Thoth may send the counter-notice to the original notifier and may restore the material after the applicable waiting period unless the notifier reports a filed court action seeking to restrain the activity. Restoration remains subject to law, court orders, other rights and Platform rules.

6. Repeat infringement and rights-management policy

Where appropriate and legally required, AERLYO may suspend or terminate accounts that repeatedly infringe intellectual-property rights, consider valid notices and counter-notices, prevent re-upload of identified material where lawful, and preserve evidence required for claims, defense or lawful requests. Thoth may also act on trademark, database, trade-secret, publicity, privacy or counterfeit complaints using a proportionate process even when the DMCA does not govern the claim.

7. Trademarks, domains and brand protection

AERLYO, its icon, word mark, aviation interface, product names, slogans and associated trade dress are claimed marks of Thoth Group LLC to the extent used and owned. They may not be used in a company or product name, domain, social account, application listing, keyword advertisement, metadata, aircraft livery, merchandise or other manner likely to cause confusion, imply endorsement, divert users or misrepresent affiliation. Nominative reference must be accurate, limited, necessary and must not use stylization or placement suggesting sponsorship.

No license to a Thoth trademark is created by membership, operator approval, sponsorship or an aircraft listing. Approved co-branding must follow written brand guidelines and ends immediately when authorization ends. Thoth may pursue domain-name, app-store, marketplace, platform and court remedies against confusing or bad-faith use.

8. Enforcement, evidence and no waiver

Thoth may use access controls, watermarking, rate limits, audit logs, content fingerprints and other proportionate measures to protect rights and investigate suspected misuse. It may seek takedown, suspension, account termination, preservation orders, injunctions, damages, profits, costs and other remedies available by law. Users must not destroy relevant evidence after notice of a dispute.

Failure to object to one use is not consent to another and is not a waiver. If a restriction is unenforceable, it is narrowed only to the minimum extent necessary and the remaining provisions continue. Nothing in this notice prevents fair use, quotation, interoperability, whistleblowing, security research or another right that applicable law makes non-waivable.
